MyGallery Terms of Service
These Terms of Service ("these Terms") set out the conditions of use for MyGallery ("the App"). They apply to the provider of the App ("the Provider") and to users of the App ("the User"). By using the App, the User agrees to these Terms.
1. About the App
The App is a simple gallery app that lets you view and manage the photos and videos on your phone, organized by folder. When you set up a cloud storage connection, photos and videos stored in the cloud can be displayed in the same way as media on your device, and the connection can also be used as a backup destination.
The App mainly provides the following features.
- Viewing photos and videos organized by folder
- Full-screen viewing of photos and video playback
- Editing photos and videos (crop, rotate, filters, drawing, adding text, and more)
- Per-folder display, sorting, grouping, and pinning
- Copying, moving, and deleting photos and videos, and moving them to the trash
- Map view of photos and videos with location data
- Support for Google Cloud Storage / S3-compatible storage
- Backing up to a configured cloud destination
2. Operating Environment
The App currently mainly supports Android. Depending on your device, OS version, storage permissions, network environment, and the specifications and permission settings of your cloud storage, some features may not be available.
3. Use of Permissions
The App may use device permissions to provide its features. Details of the permissions used are governed by the separately published Privacy Policy.
If you do not grant a required permission, some or all features of the App may be unavailable.
4. Use of Cloud Storage
You may only set up cloud storage in the App that you manage or have the right to use.
If you use Google Cloud Storage, the App authenticates using your Google account and uses read/write permissions to Cloud Storage. If you use S3-compatible storage, you configure the endpoint, bucket name, access key ID, secret access key, and similar information.
Use of cloud storage is subject to each cloud provider's own terms, pricing, capacity limits, bandwidth limits, access permissions, and security settings. You are responsible for managing these and for any costs associated with their use.
5. Notes on Data Operations
Through your own actions, or through sync settings you have enabled, the App may copy, move, upload, delete, or restore photos and videos on your device or in cloud storage.
You are responsible for managing important data yourself, such as by creating backups in advance. Except in cases of the Provider's willful misconduct or gross negligence, the Provider is not liable for loss, corruption, duplication, or unintended moving or deletion of files arising from use of the App.
6. User Responsibilities
You are responsible for the following.
- Managing on-device media, cloud storage, credentials, and access keys
- Checking the access permissions and visibility settings of the cloud storage you set up in the App
- Using the App without infringing copyright, portrait rights, privacy, or other third-party rights
- Using the App in compliance with applicable law, each cloud provider's terms, and these Terms
7. Prohibited Conduct
When using the App, you must not:
- Violate laws or public order and morals
- Infringe the rights, privacy, honor, or credibility of third parties
- Use accounts, credentials, or access keys obtained unlawfully
- Place an excessive load on the App, cloud services, or third-party systems
- Unlawfully reverse-engineer, modify, or redistribute the App
- Use the App to cause harm to third parties
- Engage in any other conduct the Provider deems inappropriate
8. Usage Analytics Data
To improve the App, the App may send usage analytics data using Google Analytics for Firebase. You can disable this in Settings.
Details of usage analytics data are governed by the separately published Privacy Policy.
9. Disclaimer
The App is provided "as is." The Provider does not guarantee that the App will be fit for your particular purpose, will always operate correctly, that no data will be lost, or that cloud storage integration will always be available.
The App's features may be limited or suspended due to changes made by cloud providers, Google, Firebase, the OS, devices, networks, storage, or permission specifications.
Except in cases of willful misconduct or gross negligence on the part of the Provider, the Provider is not liable for any damages arising in connection with your use of the App. However, where the Provider is liable under applicable law, that liability is limited to ordinary and direct damages, and is capped at the amount you paid the Provider in connection with your use of the App during the 12 months preceding the occurrence of the damages.
10. Changes to or Discontinuation of the App
The Provider may add features to, change, suspend, or discontinue the App as needed.
11. Changes to These Terms
The Provider may change these Terms as needed. Revised Terms take effect once posted within the App, on the distribution page, or in related documentation.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Japan.
13. Language
The Japanese-language version of these Terms is the authoritative text. Translations into English or other languages may be provided for reference only. In the event of any conflict or inconsistency between a translation and the Japanese version, the Japanese version shall prevail.
14. Exclusive Jurisdiction
Any dispute arising in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the Osaka District Court as the court of first instance.
